When I create a publication using letter size paper all elements when printed
are in their proper place. However when the paper type is changed to legal
size the top graphic appears half way down the page. Any idea why?

The graphic is in the same place as it was in the letter size paper. It just
appears to have moved.
Open a new instance of Publisher, create a rectangle the size of the letter
publication, copy and paste to the legal publication.
